STANDARD TRADING CONDITIONS FOR FREIGHT FORWARDERS

These are the Standard Trading Conditions applicable for our services, as amended

Scope of Services:

These conditions apply to all services provided by FREIGHTOM , including but not limited to freight forwarding, warehousing, and logistics.

1. Liability Limitations:

FREIGHTOM shall not be liable for any loss, damage, or delay of goods beyond the amount of HKD 500 per shipment unless a higher value is declared and additional insurance is purchased by the customer.

2. Insurance:

Customers are advised to obtain their own insurance coverage for goods. FREIGHTOM can arrange insurance upon request, subject to additional charges. Cargo Insurance if arranged under instruction by Shipper/Consignee is just to help to avoid coordinating with multiple agencies. In case of any claim for loss and damage, the documentation has to arrange directly by Shipper/Consignee to the Insurance Company. Acceptance of claim and/or settlement is purely as per claim settlement procedure of the Insurance Company and FREIGHTOM will not be in any way responsiblefor rejection of claim or the quantum of claim paid”

3. Customer Obligations:

Customers must provide accurate and complete information regarding the goods, including nature, weight, dimensions, and any special handling requirements. Proper packaging is the customer’s responsibility.

4. Force Majeure:

FREIGHTOM shall not be liable for any failure to perform services due to circumstances beyond its control, including but not limited to natural disasters, strikes, or governmental actions.

5. Claims Procedure:

Any claims for loss or damage must be submitted in writing within 7 days of delivery. Claims must include all relevant documentation, such as the bill of lading and proof of value. Claims beyond 7 days will not be acceptable.

6. Jurisdiction and Governing Law:

These conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

7. Indemnity:

The customer agrees to indemnify and hold FREIGHTOM harmless from any claims, damages, or liabilities arising from the customer’s failure to comply with these conditions or from incorrect information provided by the customer.

8. Subcontracting:

FREIGHTOM reserves the right to subcontract any part of the services. The subcontractor shall be subject to the same terms and conditions as FREIGHTOM

9. Payment Terms:

Payment for services is due within 30 days of the invoice date unless otherwise agreed in writing. Late payments may incur interest charges at a rate of 1.5% per month.

10. Lien:

FREIGHTOM shall have a lien on all goods in its possession for any unpaid charges. The company may sell the goods to recover unpaid amounts after giving notice to the customer.

11. Confidentiality:

Both parties agree to keep all information related to the services confidential and not disclose it to any third party without prior written consent, except as required by law.

12. Severability:

If any provision of these conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Amendments:

These conditions may be amended only in writing and signed by an authorized representative of FREIGHTOM

Notices:

Any notices required under these conditions shall be in writing and sent to the respective addresses of the parties as specified in the contract.
